Changement de statut

Le changement de statut est une procédure qui permet à un étranger qui résident en France d’obtenir un titre de séjour sur un autre fondement du Code de l’entrée et du séjour des étrangers et du droit d’asile (CESEDA). Par exemple, c’est le cas d’un salarié qui voudrait créer une activité libérale ou bien commerciale et obtenir une carte de séjour temporaire « entrepreneur » ou bien une carte  pluriannuelle « passeport talent entrepreneur ».

Changement de statut salarié à entrepreneur

Vous souhaitez vous lancer dans l’aventure entrepreneuriale ! Mais vous êtes actuellement salarié (non ressortissant de l’Union européenne) titulaire d’un titre de séjour “salarié”. Vous pouvez changer votre statut et obtenir, selon votre projet, un titre de séjour « entrepreneur » ou bien une carte pluriannuelle « passeport talent entrepreneur » La demande de changement de statut doit être déposée à la préfecture de votre lieu de résidence.

La demande de changement de statut de salarié à entrepreneur implique nécessairement la demande d’un avis à la Directions régionales de l’économie, de l’emploi, du travail et des solidarités « DREETS ».
La procédure de changement de statut de salarié à entrepreneur que ce soit pour la carte « entrepreneur » d’un an ou bien pour la carte pluriannuelle « passeport talent entrepreneur » implique nécessairement d’avoir un projet d’entreprise viable susceptible de générer des revenus en France.
Les clients de la future entreprise peuvent être situés en France et à l’étranger. C’est pourquoi le changement de statut vers un titre de séjour « entrepreneur » ou « passeport talent entrepreneur » est la meilleure option pour toute activité nomade !
L’étranger qui souhaite changer son statut et créer son entreprise ou s’enregistrer pour excercer une profession libérale (comme architecte, avocat, médecin etc.) doit donc d’abord obtenir de la DREETS un avis portant sur le projet d’entreprise.
La DREETS est en effet chargée de donner son avis sur la viabilité des projets de création d’entreprise portés par des ressortissants étrangers sollicitant une carte de séjour pluriannuelle portant la mention « passeport-talent création d’entreprise » ou une carte de séjour temporaire « entrepreneur-profession libérale » ou de reconnaitre le caractère innovant d’un projet économique porté par les ressortissants étrangers sollicitant une carte de séjour pluriannuelle portant la mention « passeport talent projet économique innovant ».

Pour cela, vous devrez soumettre, entre autres documents, un plan d’affaires (business plan) comportant la description de votre projet d’entreprise, une étude de marché, des indicateurs économiques etc.
Une fois l’avis obtenu, il sera nécessaire de déposer la demande de titre de séjour correspondante à la préfecture. La préfecture n’est pas liée par cet avis, même s’il est défavorable, mais un avis favorable augmente les chances de succès de votre demande !
Il faut savoir que l’acceptation du changement de statut n’est pas un droit, n’est pas automatique.
Le préfet et l’administration ont un pouvoir discrétionnaire en la matière. Cela signifie que même si vous remplissez tous les critères, le titre de séjour peut être refusé.

Born in Brazil, where I started my Law studies, changing to Law School in Portugal and got my degree from University of Porto in 2021. I got a Master’s  in European Law in Paris, at the University Paris 12. I have been having an enriching experience during my traineeship at Lexidy, where I get to complete with practical skills the knowledge I have acquired during these many years of  legal studies. What I like to do the most is reading and cooking. I am fluent in Portuguese, French and English, and I am currently learning German.

Born in Valencia, Spain, he started a Double Degree in French and Spanish Law between the Universitat de Valencia and the Université Toulouse 1 Capitole. Along with this degree formation, he specialized in European and International Law in for two years, completing it with a Master Thesis about the Evolution of the concept of States Boarders in the light of Internet. During my Master’s degree, Hector was able to discover Immigration law through the lens of European and French Law. Throughout the internship at Legal Service at the European Parliament, he learned the practical side of European and Public International Law from the lens of creation and conclusion of International Agreements. Finally, his experience at M&B Avocats helped to develop the profile as a French and Spanish Law Jurist, knowing the insights and particular traits of both legal systems. Speaks: English, Spanish, French.

Her European studies focus on the European asylum and immigration policies.
