So what is the National Situation of Employment in Spain?
In a nutshell, the National Situation of Employment (NSE) is the mechanism that the Spanish Government employs in order to discourage the hiring of foreign workers (non-EU).
It basically boils down to the following reasoning: âIf the unemployment rates in Spain are high, you have no reason to hire a foreign worker instead of a Spanish oneâ.
This obstacle, if not actively confronted when applying, may well be the sole responsible for the rejection of your application.
Is the National Situation of Employment still an issue in Spain?
Yes. Since the employment crisis in Spain seems endless, having started almost a decade ago and with no prospect of being over soon, you may find yourself losing all hope of a professional future in the country.
Are there ways to overcome this obstacle?
Fortunately, avoiding the NSE, while hard, is not completely impossible.
On a quarterly basis, the Spanish Public Service of Employment issues a report listing the positions of difficult coverage (meaning, positions that, at the moment, have a demand greater than supply).
Any position or profession that is included in that list is automatically given a pass, with regards to that obstacle at least.
Before considering anything else, you might really want to take a look at that list.
What if my position isnât included in the list?
Well, should your profession not be included on this list / report (which, in all honesty is a likely possibility) then there are always other ways. The Government understands that, sometimes, job offers might be really specific and detailed and that it would unreasonable to make the employer search forever.
This is why the Administration gives employers the possibility to issue a public offer of employment before the PSE. If said offer remains unanswered for fifteen days, the PSE will produce a certificate accrediting the impossibility to cover the position.
This certificate will act as an additional justification to overlook the National Situation of Employment.
