¿Qué es un Acuerdo de Arras y un CPCV?

Ambos son contratos que los inversores inmobiliarios en España o Portugal deben utilizar al realizar la compra de una propiedad.

Un Acuerdo de Arras es para la propiedad española, mientras que un CPCV se utiliza en Portugal. Estos contratos son entre el dueño de la propiedad y el comprador e incluyen detalles como el precio de compra/venta y el acuerdo de firma. Ya sea que esté en España y use un Arras o en Portugal y necesite un CPCV, ambos son esencialmente acuerdos previos para completar una transacción inmobiliaria.

Actúan como una forma formal de reservar una posible transacción inmobiliaria en España o Portugal cuando el comprador aún tiene que completar los requisitos formales para completar la transacción completa. Esto puede incluir: finalizar la aprobación de la hipoteca o finalizar un procedimiento de licencia.

¿Cómo trabajan?

¿Qué son los requerimientos?

Si bien no existen requisitos obligatorios para completar y finalizar un Acuerdo de Arras o CPCV, es vital que revise cuidadosamente toda la documentación con un experto en bienes raíces antes de firmar cualquier papeleo. Estos documentos son esencialmente contratos de promesa en los que ambas partes acuerdan derechos y obligaciones específicos que tienen consecuencias financieras.

Por ejemplo, si encuentra un problema después de firmar el Acuerdo de Arras y se retira de la compra, perderá el pago inicial del 10 % que realizó.

Recomendamos que el comprador espere a que se verifiquen los siguientes documentos para proceder:

  • Certificado Permanente o Nota Simple
  • Catastro Urbano
  • Licencia de uso de la propiedad;
  • Certificado Energético.

¿Cuál es el proceso para un Arras o CPCV?

  1. Reúna la documentación pertinente, lo que suele llevar a los clientes hasta 15 días.
  2. Verificar la viabilidad del inmueble y los trámites, como el Arras o el CPCV. Sugerimos asignar hasta 30 días para esto.
  3. Redactar la escritura. Pasaremos hasta diez días en este paso, dependiendo de las demandas de la otra parte.
  4. Firma el contrato. Puede hacerlo en ausencia otorgando un «Poder notarial» a un experto en bienes raíces

En España, el contrato se considera resuelto y el comprador tiene derecho a recibir el 10% del pago inicial.

En Portugal, depende del comprador.

Puede evitar la pérdida de cuotas y depósitos haciendo que la aprobación del préstamo sea una condición del contrato.

La parte que no haya firmado deberá indemnizar a la otra parte con la cantidad pactada en el Convenio de Arras o CPCV.

Sin embargo, si ambas partes todavía están interesadas en firmar el contrato, pueden acordar continuar y renunciar a la compensación.

Por lo general, las partes acuerdan 30 meses, pero es posible incluir una cláusula de extensión de tiempo. De todos modos, eso depende del acuerdo concertado.
