MARRIAGE AND REGISTRATION AS A STABLE COUPLEWe offer a variety of services, should you wish to formalise your relationship in Spain.
Getting married in Spain
If you wish to get married in Spain, it would be our pleasure to assist you with the Spanish administrative process.
Getting registered as a stable couple
If you do not wish to get married, another option that offers not all but many of the advantages is to get registered as a stable couple. This status for example also allows you to get a Residence Permit for Family Members of EU Citizens for a non-EU partner who lives with an EU citizen.
Constitution of a Stable Couple
The process depends on the autonomous community you reside in. Let us know, and we will instruct you on your case.
Dissolution of a Stable Couple
In case you wish to dissolve the stable couple, you have to go to the notary's office and agree to execute a deed of dissolution of the stable couple, if you both agree to end your relationship. If there is no mutual agreement, the dissolution can also be carried out by going to the notary's office alone, although the other partner must be notified of the decision. Keep in mind that the regulation of the stable couple is different in each autonomous community, not existing regulation at state level, so the notary will have to explain the consequences of the extinction in each concrete case. Our lawyers would be pleased to guide you through the whole procedure and to accompany you to the notary public, if possible.
Prenuptial Agreement
At Lexidy, our experts are ready to assist you with drafting a prenuptial agreement, which is a contract between two people before marriage that specifies the assets of each person and how they will be distributed in the event the marriage is terminated due to unnatural causes. The purpose of such agreements is to regulate what the future of the spouses and their assets will be in the event of divorce, with the peculiarity that such agreements have been made outside a context of personal crisis. This guarantees the objectivity and good faith with which these agreements should be reached, and facilitates the divorce and, if necessary, the liquidation of the estate, to be carried out in a simple and rapid manner.
DIVORCEWe are at your service and by your side should you be facing a divorce. Our experts are here to help you navigate the legal aspects during these difficult times.

There are different divorce options, all of which we can assist you with:

Divorce by mutual agreement
Our lawyers are here to assist you if you are planning on getting an amicable divorce at a Notary Public’s office.

Children Custody in Spain

Sorry to tell, Lexidy does not provide assistance with child custody.

LAST WILL AND TESTAMENTAt the moment of a person’s death, the assets they leave behind are divided between the relatives that inherit. If there is no last will and testament to guide the aforementioned division, the law decides on who gets what, giving preference to spouse and children.
In case one wishes to have a say in what is inherited by whom, one has to leave a last will and testament as instructions. There is no limitless liberty, but it is possible to take decisions within the legal framework.
In order to grant a last will and testament in Spain, you have to realise the following steps:
1. First step: Determine the law
According to International and European conventions, you can choose either the law of your nationality or that of your place of residence.
2. Second step: Define your patrimony and your heirs
As a second step you have to take inventory and prepare a list with all your assets and debts that compose the inheritance as it will form part of the will. You must define precisely what you want to transmit and to whom.

Both personal and business assets of your company can be transmitted.
3. Third Step: Choose the most convenient form of will
Spanish law provides the possibility to grant different types of wills, including the “open will in a public form”, which is the most common scenario. In this regard, it is important to make sure who will be designated as your heir or heirs. Also, apart from your heir or heirs to be instituted (compulsory procedure) you can also legate a specific asset to someone through a legacy.
4. Drafting of the will
As a last step, you draft the text of the will. Depending on the form of will you have opted for, a Notary Public will assist with this step to make sure that you have worded everything as per your intentions.
