[vc_row][vc_column][vc_column_text]In 2019, there have been some changes in the requirements for obtaining Spanish nationality. Below, we will summarise some of the most important novelties.
Period of legal residence
From now on, it will be able to take advantage of the reduced term (2 years) if:
- An applicant has a residence card in Spain with a nationality for which 10 years of residence are required,
- But also has another nationality for which only 2 years of legal residence are needed.
Computation of Spainâs absencesÂ
The old system allowed for the applicants to spend no more than a total of 6 months outside of Spain during the required 10 years (for foreigners requiring 10 years of legal residence prior to application), and a total of 3 months in the computation of 1 or 2 years for all other cases.
It will be required that the absence has not been for 6 or 3 continuous months depending on the case. In other words, there can be several departures in 10 years that, in total, exceed 6 months. But the requirement of continuity will be understood to be fulfilled as long as none of these departures exceeds 6 continuous months. Therefore, there will be more travel flexibility for foreigners.Â
In case the applicant becomes illegal during the process
Another of the changes refers to the case where the applicant finds themselves without a residence permit during the process. While this was previously a cause for refusal, now it will not be anymore.Â
If a foreigner fulfills the requirements at the time of the application for nationality but at a later moment loses their residence permit, for example, by not renewing it, the application for nationality may still be resolved in their favour.
Dispensation of Spanish nationality examinations
It is no longer necessary to apply for exemption from the examination if you have studied Compulsory Secondary Education, vocational training, bachelor or university studies. Along with the application for nationality, it will provide the titles that accredit the passing of these studies and resolve the nationality and the exam won’t be needed.
