How Will Brexit Affect British Citizens Currently Residing In Spain And Seeking Relocation?

As you may know, Brexit will occur on January 31st and since the United Kingdom is exiting the European Union, its citizens will no longer be considered European citizens, therefore, will no longer be able to benefit from the European laws. However, this will not happen in a blink of an eye since there is a period of time, the so-called, period of transition, during which British citizens who wish to exercise their freedom of movement before the definitive withdrawal will be able to regularise their situation in Spain under the European Union regime. Find out in this article the options you have if you are living in Spain or are planning to relocate there.

The Withdrawal Agreement

In Spain, European citizens that want to live in the country for more than 3 months must register as residents and obtain the EU Certificate, which is a green card that identifies them as EU citizens living in Spain. This is a quite straightforward process and it is a way for the Spanish Government to keep track of the European citizens residing in the country.

Since the UK will leave the European Union with a deal, if you arrive in Spain before the end of the implementation period, that is, December 31st 2020, you will be able to register as resident in Spain under the current rules, and will have your right to reside in Spain protected for as long as you remain resident.

As the transition period is set until 31st December 2020, the Agreement states that you may have to apply for a residence status to confirm you were already a resident before the end of the mentioned period so you can work, live and travel as you did before the 31st December 2020. The application of the residence status can be done from the 30th of June 2021 and every EU country will set the rules for the process. In any case, this process is meant to be short and simple.

Also, if you are already in Spain with a permanent residence permit, you will also need to apply for a residence status and you will have until June 30th 2021 to exchange your permit for a new one free of charge.

The implementation period also affects your direct family members, as your spouse, registered partners or children, who would like to relocate to Spain. They will be able to join you in Spain under the current rules after the implementation period.
